EPA nixes ‘grandfathering’

Reporters and editors don’t especially like big, boring problems – they can be difficult to explain, taking up a lot of words and lacking dramatic photos and illustrations. So kudos to Slate for pulling out this new EPA rule nugget that actually matters – a lot.

But the new methane rule goes beyond merely undoing the damage of the Trump years. The proposal is broader than its Obama-era predecessors, and once finalized, will apply to hundreds of thousands of previously unregulated emission sources, like wells, storage tanks, and compressor stations. That is because unlike the prior standards, Biden’s rule will cover equipment of all ages. EPA thus avoids a key conceptual error that has undercut agency initiatives for over five decades under administrations of both parties: The old rules regulated only new facilities, while exempting older ones from emission limits. In contrast, Biden’s rule covers new and old emitters alike.

And methane, the primary ingredient in natural gas, is a big problem. The gas has a startlingly powerful greenhouse effect when released directly into the atmosphere, trapping 86 times more heat over a 20-year period than an equivalent amount of carbon dioxide. As a result, while methane accounts for only 16 percent of global greenhouse gas emissions, it is responsible for almost a third of current, human-caused warming. And here in the United States, oil and gas installations are the largest industrial source of methane, due both to leaks and intentional venting during the production process.

The Obama administration recognized the need to reduce methane emissions from the oil and gas sector back in 2016 and crafted regulations to do so. But those restrictions applied only to equipment constructed in 2015 or later, leaving the vast majority of the sector’s sources and emissions uncontrolled.

This story was troublingly familiar. Regulating new sources of pollution strictly and existing sources laxly or not at all is known as “grandfathering.” The EPA has engaged in the practice before, with disastrous results. Indeed, we wrote an entire book about the terrible consequences of exempting existing power plants from 1970s emission limits on soot- and smog-forming pollutants.

On the subject of other troublesome old mistakes, the EPA had no comment about toxic emissions emanating from all the crazy uncles still out there. Sources say they continue to study the issue.

Tenther limits

Apparently, the 10th Amendment Sovereignty Movement is all well and good until it begins to effect air pollution requirements:

Because of California’s historical air pollution problems, the federal Clean Air Act gives California the right to establish stricter guidelines than the federal government — so long as it gets a waiver from the EPA. The Obama administration granted the state such a waiver on greenhouse gas emissions from cars, although the state and federal governments wound up agreeing on a joint plan to reduce carbon emissions by about 30 percent by 2025.

Almost from the day he took office, though, Trump has vowed to roll back the Obama standards, and laid plans to revoke California’s waiver.

That prompted California in July to engineer a major coup: Ford, Honda, BMW and Volkswagen cut a deal with Newsom and the California Air Resources Board to reduce carbon emissions at a far swifter rate than the Trump administration wants. The deal represents a compromise on the original Obama standards by giving the automakers an extra year, until 2026, to meet the climate change targets.

Newsom later announced that Mercedes Benz is on the verge of agreeing to the same standards as the other four companies.

The announcement reportedly infuriated Trump. Earlier this month, lawyers for the EPA and the federal Department of Transportation sent a letter to Air Resources Board Chairwoman Mary Nichols, saying the deal with the automakers appears to be “unlawful and invalid.” Separately, numerous media reported that the U.S. Justice Department had launched an antitrust investigation into the four carmakers’ participation in the deal.

Let’s make sure to stipulate just what we’re talking about here – the ability of the nation’s largest state to reduce carbon emissions. Civil right, gun control, healthcare, and voting standards must all be subservient to the wishes of purity-driven state governments.

Reducing carbon emissions and protecting people, the environment, companies and the Clean Air Act itself is a bridge too far.

Nothing for Water

One of my colleagues is being interviewed and quoted widely about this week’s deadly tornado in Oklahoma. As he tries to makes sense of the connections between extreme weather and climate change, I sure hope he can get through to some people who have been, let’s say, stubborn about the whole thing.

But another issue that is bad enough on its own but also brings that broader issues into focus is the draining of the Ogallala Aquifer in Texas. It’s important to remember about global warming and its associated devastations: the Earth will be fine – it’s people that won’t survive, especially difficult without water:

The Ogallala Aquifer suffered its second-worst drop since at least 2000 in a large swath of the Texas Panhandle, new measurements show.

The closely watched figures, published this week by the High Plains Underground Water Conservation District, cover a 16-county area stretching from south of Lubbock to Amarillo. The Ogallala wells measured by the district experienced an average drop of 1.87 feet from 2012 to 2013. That makes it one of the five or 10 worst drops in the district’s more than 60-year history, said Bill Mullican, a hydrogeologist with the district.

“There are some pretty remarkable declines,” Mullican said. One well in the western part of the water district, he said, dropped 19 feet over the year.

The vast majority of Texas is enduring a drought, but the Panhandle has been especially hard hit, causing farmers to pump more water to make up for the lack of rain. That depletes the amount of water stored in the aquifer over the long term, which means future generations will find less water to pump to grow crops.

What water are the water greatest water global challenges?

Did I say water? In England they call them ‘hosepipe bans’ but it seems our language brethren are experiencing a wee problem with drought:

The south-east of England and East Anglia are already in the grip of the UK’s worst drought in 30 years. Seven water companies have indicated that they will impose hosepipe bans. Most will begin next month, but some could start earlier.

This in a country known as having one of the wettest and dampest climates in the Northern Hemisphere. So it’s a bit weird to think of the UK in terms of drought. But there it is. Weird = new normal.

And maybe we can begin to understand what drought is like in parts of the world that are not historically wet, which have a lot of people and (already) very little water. It has been happening for years, with tragic consequences for man, land and beast.

Changing Approach to Water

Not that we can sneak up on it, but getting used to dealing with the implications of its scarcity. Even if not directly, though every region will have its bouts with drought and flirtations with conservation, fallout from water shortages range far and wide, as the situations in Kenya and Mexico attest. And voila, it’s not just a shortage of rainfall but a dynamic mixture of poor planning and short-sightedness that builds in non-trivial amounts of waste into our concepts of ‘use’:

Mexico’s hurricane season has been mild, with no major hits so far this summer, though a weak Hurricane Jimena dropped plenty of rain on parts of Baja California and the northwestern state of Sonora last week. The sparse rainfall nationwide has made 2009 the driest in 69 years of government record-keeping, Arreguin said.


Even before the drought, managing water was one of the most vexing issues for Mexico City, which 500 years ago was a big lake. Now paved in asphalt and concrete, the city pipes in much of its water (then, through separate plumbing, expels wastewater to prevent flooding during rainy times).

Since most rainwater pours down storm drains into the sewer network, it is not absorbed into the underground aquifers that are the city’s main source of water. Decades of over-pumping is emptying those deposits and causing Mexico City to sink, in some places by more than a foot a year.

So… just so you know, there’s no sitting back and feeling bad for those poor people in a “but for the Grace of God… ” kind of way. Sorry, all out of isolated, unconnected events. Come back next… time? To recap, we are subject to not just immediate, local effects but larger pressures on surrounding ecosystems and political systems which emerge, gain strength and ripple outward. How do we study, learn about and prepare for how these things work together? Do we? Perhaps a better question would be how can we understand these kinds of long-term phenomena when we’re more concerned with fanning debates about evolution, gay marriage, presidential birth certificates and other ‘issues’ I largely ignore on this site in favor of more problematic, actual problems? Alas, there’s a short answer.
